Is my freezer temperature too unstable

I bought a new Whirlpool side by side refrigerator freezer. I noticed quickly that ice cream was soft and I put a thermometer data logger in the freezer and found the temp was cycling between about +5 and 25 F and averaging about 13 F (measured with door closed continually over ~ 20 hours). After about 5 visits from the Whirlpool refrigerator technician they concluded it was unrepairable and replaced it with a new unit. However the freezer on the new unit also seems to fluctuate a lot in temperature. I don't store a lot of food in the freezer, and the new unit cycles between -3 and +20 F every 90 minutes and averages about 10 F. I filled the freezer with pans of water to test it under "full" conditions. This helped somewhat, but it still cycles from about -4 to +12 F every 90 minutes and averages about 3.7 F. I called it in under warranty again and the technician's initial response was "they are all like this nowadays," which I did not accept and he is attempting further "repairs" My question - is this safe and acceptable performance for a freezer (especially a brand new one)? What is a reasonable average safe temp range and fluctuation with door closed for a properly functioning freezer?
