you'll have to have your brother bring it to a apple store to get it removed, and proof he actually owns the phone (a receipt should work)
i wouldnt recommend a "unlocker" as they really just reprogram the cpu into thinking the icloud lock is gone, therefore affecting your phones already slow processor to make it even slower, much less theres virtually no unlockers for a iphone that old
-also, that iphone is 10 years old, making it kinda dangerous to use on the internet, as the last time it got a update would have been in about 2016-2015..... about 7 years ago....
