upper screen brighter then bottom

i have a problem with my 3ds. the upper screen is brighter then the bottom screen and it hurts my eye when i play on it for a bit, also it tends to die very quickly for some odd reason. i tried changing the brightness but only the bottom one change and the upper screen gets brighter when doing so
